Meeting Minutes

Town Hall Conference Room A



Call to order:   The Pepperell Board of Health was called to order at 7:15 pm, by Mr. Durno. He informed all present the meeting was being tape recorded.

Staff Present:          Kalene Gendron R.S., Health Agent, Sandra Grogan, Board Secretary

Guests Present:       Paul MacDonald, Nashoba Publishing, John Lindermuth, 23 Maple St., Jessica Cathcart, 222 South Rd. Apt. 1, George Clark, 4 Mason Rd., Valarie Eaton, 38 Cranberry St.


Minutes to be approved:   Mr. Marriner made a motion to approve and accept the minutes of 1/24/2012 with a minor correction.  Mr. Durno seconded it. A vote was taken. All were in favor.

Appointment: 1

George Clark-License

  • At the previous Board meeting, the members of the Board did not sign off on Clark’s Community Home Park permit as there was a discrepancy over the application’s number of units allowed.
  • Mr. Clark attended the meeting and explained the ruling dating back to 1981 that a judge’s verdict allowed not to exceed 84 units in the park.
  • Mr. Durno had asked at the previous meeting to see something in writing, the Secretary presented a copy of the judge’s ruling.
  • The Health Agent (HA) will correct the license and bring it in for the next meeting.

Mr. Marriner did not participate in the discussion as he is an abutter to the property.



John Lindermuth

  • Veterinarian Dr. John Lindermuth appeared before the Board to express his interest in sharing in the rabies clinic.
  • Mr. Durno suggested alternating the rabies clinic between veterinarian, Dr. Smith and Dr. Lindermuth.
  • This year Dr. Smith will hold the rabies clinic on April 7, 2012 at the Jersey St. fire station from 9:00-12:00 pm.
  • Mr. Durno suggested to Dr. Lindermuth that if he interested to shadow Dr. Smith at this year’s rabies clinic to see exactly what is entailed in running this event.











222 South Rd. – Jessica Cathcart








·        Ms. Cathcart a tenant at 222 South Rd. had informed the Board that the landlord who had been given a 60-day extension on December 6, 2011 had until February 6, 2012 to correct the remaining violations, which have not been corrected.

·        The HA had inspected the apartment and a substantial amount of violations remain.

·        Ms. Cathcart explained she has not stopped the landlord from entering her apartment to fix the problems.

·        The landlord has taken this to court in hopes to have the court evict Ms. Cathcart from the apartment.

·        Mr. Durno wants the landlord, Joann Arsenault to be at the next meeting, to find out why she hasn’t corrected the violation and if we have to “we’ll take stronger action” by taking her to court if need be.

·        Mr. Marriner said “we have a list of violations that the landlord must make go away.”




38 Cranberry St.

·        Valerie Eaton came before the Board with confirmation in writing by the building department and fire department that this trailer is not livable.

·        This came about by a neighbor saying the trailer is housing a person.

·        The Board was satisfied with the letter.



PBOH - Updates

  • Mr. Durno mentioned he had seen the police department with collapsible cones and thought it may be a good idea to have some.
  • The BOH will contact the police department to get more information about them.



New Business: F

ZBA – Proposed changes to regulations

  • The planning board is proposing changes to the definition of domestic animals into the zoning regulations. They would like to expand their definition of domestic animal
  • The HA suggested the may want to entertain the idea of animal regulations, stable regulations. If this proposal takes effect and the BOH gets a nuisance call of domestic animals roaming, at least the BOH will have regulations in place. As it stands we only have no animal regulations.
  • At the next meeting we will have surround towns regulations and review them.
  • Mr. Durno would like to see a set limit of animals allowed on properties.




  • One Bill Warrant
  • Rubbish Hauler – Republic Service

The Board approved and signed the bill warrant and the rubbish hauler license.



Mr. Marriner made a motion to adjourn the meeting. Mr. Durno seconded it. A vote was taken. All were in favor.

Meeting was adjourned at 8: 45 pm
