Meeting Minutes

Call to order:   The Pepperell Board of Health was called to order at 7:00 PM by Mr. Buckley. He informed all      present the meeting was being recorded.  


Members Present:   Alfred Buckley, Chairman, John Marriner, Member

Members Absent:    Phillip Durno, Member                                                                                                                          

Staff Present:          Kalene Gendron R.S., Health Agent, Sandra Grogan, Board Secretary

Guests Present:       Beverley Crane, 12B Foster St., John Gendreau, 64 Nashua Rd., Kris & Charles Ellis, 6 Sheffield St., Edward Godsoe, 18 Maple St. Lot 34

Minutes to be approved:   Mr. Marriner made a motion to accept the minutes of April 19, 2011, as is.

                                          Mr. Buckley seconded it. A vote was taken. All were in favor.

MA DEP – Draft Letter

  • At the April 5, 2011 meeting Mr. Marriner asked about a letter requesting DEP to reduce the number of tests at the landfill.
  • The Health Agent drafted a letter according to their request and presented it before the Board to review.
  • Mr. Marriner said “he didn’t see severe fluctuation in the testing results” so he would like a formal letter be sent asking for reduction of testing.
  • The Health Agent should have it ready for the next meeting.
  • The Health Agent informed the Board, CEA’s field crew was denied access to test three gas vents on a neighboring property. The homeowner requested monitoring results for the past ten year.
  • The Board wants to know why after ten years of sample testing these gas vents why the neighbor is requesting ten years of testing results, and if these gas vents are on the neighbors property.




12B Foster St. – Trash/Debris

18 Maple St. – Lot # 43






  • The Health Agent had sent an order to clean up the trash and debris.
  • The tenant Ms. Beverley Crane has cleaned up the trash but needs time to clean up remaining debris.
  • The Board allowed a time extension to June 7, 2011.






  • A letter was sent to Mr. Godsoe, requesting his presence before the BOH.
  • Mr. Godsoe, informed the Board of his progress in bringing his unit up to livable standards and code. He is putting skirting around the bottom of the trailer, he said he has running water, 100 watts of electricity going into trailer, and is waiting to for fuel assistance to help with purchasing a gas heater.
  • The Board made Mr. Godsoe cognizant that if he wanted to continue to live there he has to have hot/cold running water, heat and electricity.
  • Mr. Godsoe said he had an electric heater that plugs in. He is waiting for financial assistance for a wall mounted gas heater.
  • The Board agreed to give Mr. Godsoe until June 6, 2011 to have his trailer up to code and livable. At that time the Health Agent along with a Board member will do a re-inspection.
  • The Board tabled this discussion until June 7, 2011.



New Business:

4 Sheffield St. – Animal Complaint


  • Property owners of 6 Sheffield Street appeared before the BOH asking if there is anything that can be done about the neighbor’s ducks, and chickens that roam into their yard constantly and make all kinds of noises that disrupt them.
  • Mr. Buckley asked the Health Agent if she would send a letter to 4 Sheffield St., asking the owner of the animals to contain them on their property.




19C Wheeler St.

  • A permit for a D-Box single component replacement and the baffle in the septic tank was replaced.

The Board signed the permit.


Old Business:

Hand Sanitizer Dispensers




  • The Chairman thought since the BOH has two remaining hand dispensers and boxes of refills the North Middlesex High School could benefit from having them.
  • Mr. Marriner agreed.
  • A letter will go to the school, offering the dispensers and three boxes of hand sanitizer refill.

20 Wheeler St. Rubbish/Debris






Other Item:

Sweet Tooth Marketing

43 Jewett St.
















  • An order was issued to clean up the rubbish/debris on this property.
  • The Health Agent will be doing a site visit on May 16, 2011 to see if any of the violations have been corrected.






  • The Health Agent informed the Board that someone in town is selling retail food to distributors with no food license and is on private septic system. The owner was informed his septic system would need to be upgraded but he is ignoring the guidelines.


  • The Health Agent is asking the Board to approve a letter of cease and desist on this property until he comes into full compliance.


  • The Board agreed a letter should be sent.


  • Mr. Buckley wanted to know if the owner of Chef on Wheels, in Lomar Park has his license to operate and cook there.


  • The Health Agent said “we found out after the fact” she will follow up with Bridgett who is another food inspector for NABH and get back to the Board.





Mr. Marriner made a motion to adjourn the meeting. Mr. Buckley seconded it. A vote was taken. All were in favor.

Meeting was adjourned at 8:15 pm
