June 29, 2010 Meeting Minutes

                                                                                               

 

Call to order:   The Pepperell Board of Health was called to order at 7:00 PM by Mr. Lambert

Members Present:   Robert Lambert Chairman, John Marriner Member, Alfred Buckley

Staff Present:           Kalene Garbarz RS, Health Agent, and Sandra Grogan Board Secretary

Guests Present:       Paul MacDonald, Nashoba publishing, Marcia Zamboni, 41 Jewett Street, Robin Hebert, Animal Inspector, Leah Tully & Eric Santiar, 102 Brookline St., Doug Smith, 86 Nashua Rd.         

Minutes to be approved:   Mr. Marriner made a motion to accept the minutes of May 25, 2010 as written. Mr. Buckley seconded it. A vote was taken. All were in favor.

21 Herget Dr. – Trash complaint

 

·         Mr. Lambert opened up the discussion that he driven by this property earlier in the day and he thought it looked good.

·         Ms. Lusiczka gave the Board information pertaining to her property. She feels this is an unfair complaint, as her neighbor Mr. Rubin, moved her shed that has been there for the past 28 years.

·         Mr. Rubin, had his property surveyed and said her shed was on his property.

·         Mr. Rubin, had someone come and move the shed over to her property, in the process the shed was damaged and is half not on steady ground according to Ms. Lusiczka.

·         Mr. Lambert and the Board agreed this is a civil matter that does not concern the BOH. The trash in the yard is the only concern

·         The Health Agent said a complaint was made and order was sent out. Ms. Lusiczka has the right to appeal the order within 7 days. The property line was walked; by Ms. Garbarz, and she observed rubbish, debris, refuse. According to the Health Code, you are to deep our property in a clean and sanitary manner. She would ask the Board to continue to enforce the order that was sent out June 21, 2010.

·         Ms. Lusiczka said she didn’t receive the letter until June 22, 2010, so she would like to have until that date to have all corrections made.

·         Ms. Garbarz said that wouldn’t be a problem.

Mr. Marriner made a motion to continue the order that was sent out on July 21, 2010

Leah Tully, 102 Brookline St.

 

 

 

 

 

 

·         Ms. Tully brought in a copy of the pumping record and a receipt of her new toilet. She has someone coming out once a month to pump her tank. After her last meeting with the BOH she has made changes in the house to lower the water usage.

·         The Health Agent explained the Board is going to ask her to pump more often than once a month to prevent break out. Ms. Garbarz present Ms. Tully with a legal letter that states she will connect to town sewer once it comes by her house and she will honor the Boards decision if they decide to have you pump twice a month.

·         Ms. Tully said she can’t afford to as she is disable and is having a struggle to pump once a month.

·         Mr. Lambert suggested she pump once a month.

·         Mr. Marriner suggested that her distribution box may be the problem and it would be in her best interest to get someone to check it out.

·         The Health Agent reviewed the 2002 Title 5 inspection. The distribution box was level, the perc rate was 2 minutes per inch and this is a mounded system. It is unlikely that it has been driven over.

·         Mr. Lambert asked the Board to make a motion of pumping the tank once a month and if this doesn’t work then pump twice a month.

·         Ms. Garbarz stated that if the Board honors Ms. Tully’s word then the document doesn’t need her signature.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Mr. Buckley made a motion that Ms. Tully have her septic tank pumped once a month and return in 30 days before the Board and they will determine whether she needs to increase the number of times per month she pumps the tank.  During this time the Health Agent will do a site visit.

Mr. Buckley made a motion to adjourn the meeting. Mr. Marriner seconded it. A vote was taken. All were in favor.
