Call to order:   The Pepperell Board of Health was called to order at 7:00 PM by Mr. Lambert

Minutes to be approved:   Mr. Marriner made a motion to accept the minutes of May 25, 2010 as written. Mr. Buckley seconded it. A vote was taken. All were in favor.

Leah Tully, 102 Brookline St.

 

·         Health Agent Garbarz gave a brief review of Ms. Tully’s failed septic system and the affluent discharging into the driveway and street. Ms. Garbarz has received numerous complaints. Ms. Tully had her tank pumped on May 25, 2010. Currently there is still active discharge coming out, that is a health hazard. Ms. Garbarz is asking the Board to come up with some type of solution.

·         Town sewerage is scheduled to go by Ms. Tully’s house approximately in October 2010.

·         At present the discharge is coming to the surface. This is a violation of Title 5. Another concern is the high water usage that can be exacerbating the problem. The Board may want to recommend pumping the septic tank more often.

·         Ms. Tully acknowledge she has a leak in her tub and toilet again, that adds to water usage.

·         Mr. Buckley suggested replacing the old toilet with a 1.6 gallon toilet, they save 2 to 3 gallons of water per flush.

·         The Health Agent suggested that she pump more often and submit a copy of the pumping records.

·         Mr. Lambert asked Ms. Tully if she ever talked to an installer about bringing in some fill.

·          The Health Agent advised against doing that. She reminded Ms. Tully that her once a month pumping is coming up.

 

 

 

 

 

 

 

 

 

Mr. Buckley made a motion to have Ms. Tully have her septic tank pumped at least once a month if not more depending on the flow rate. She is to send copies of the pumping records to the BOH.

·         The Board reviewed Robin Hebert, Animal Inspector performance over the past year and the Board agreed she is doing a good job. The Board would like her to keep her current position.

 

 

 

 

 

 

Mr. Marriner made a motion to appoint Robin Hebert, Animal Inspector from July 1, 2010 to June 30, 2011

 

 

Mr. Buckley seconded it.

Old Business:

12 Foster St. Units A & B

 

 

120 Main St. Apt. # 3

·         The Health Agent went to court regarding an on going problem with this property. She said all went well, Mr. O’Donnell did not show up but he had representation in his behalf that made an arrangement for all repairs to be completed by July 12, 2010. At this time all parties will be in court on that day.

·         Mr. Veo of 120 Main St., Apt. # 3 did not appear in court. The paperwork had the wrong person’s name so the Health Agent postponed his court date until July 12, 2010 since she will be at court on this date.

 

 

Old Business:

Mr. Babin – 40 Lawrence St.

·         Mr. Babin would like to rebuild a three bedroom log cabin on this property. Ms. Garbarz has received his plans. After her cross referencing with Title 5, she would like to ask the Board to place a deed restriction for a one bedroom dwelling for which the septic system was designed originally.

·         The Board agrees with this recommendation.

 

 

Old Business:

133 Brookline St. – Trash

 

131 Lowell Rd.

·         The Health Agent said there have been quite a number of trash/nuisance complaints. She is actively pursing this complaint.

 

·         The Health Agent explained this property has 25 violations, 3 are critical. The landlord is aware of an ongoing inspection. There are imminent health hazards present and due to the amount and nature of them I will keep this property on the radar screen. So far, I haven’t heard back from the tenant.

 

 

Permit:

86 Nashua Rd. – Variance request

·         The Health Agent explained to the Board that Doug Smith, Soilsmith design would like a variance request to the local regulations and an upgrade request of Title 5.

·         Mr. Smith presented his reason for asking for a one foot reduction for gravity purposes. If the Board agrees it will be a cost savings to the homeowner. In addition, he would like to request 110 gallons of water per day, per DEP rather than the 150 gallons according to the local regulations.

 

 

 

 

 

·         It will far enough away from wetlands. An inquiry was made about using cast iron underground.

·         Mr. Lambert doesn’t see any problem.

 

 

 

 

 

 

 

 

 

 

 

 

 

Mr. Marriner made a motion to accept the plan with the notation that the as-built plans show the location of the water line.

Permit:

3 Parkwood Dr.

 

·         The Health Agent has a well permit and due to the Pepperell well water regulations the type of well they are proposing needs the BOH approval. The homeowner is requesting irrigation well only. I have a statement from the licensed well driller signed and dated. I will ask the homeowner to fill out a form and sign it. I don’t see any reason why this shouldn’t be approved.

Mr. Marriner made a motion to approve the irrigation well permit.

 

Mr. Buckley seconded it.

Other Item:

 

 

 

186 Nashua Rd. - Trash

·         While Ms. Garbarz was in her vehicle she stopped a catering truck out of NH as she didn’t see a Nashoba sticker on the vehicle. He doesn’t a valid license nor is he serv-safe certified. I gave him instructions on how to proceed if he wants to sell in Pepperell.

 

·         Mr. Buckley asked about the clean up of the trash since last year the BOH had to deal with the same issue.

 

·         The Health Agent said this is the second offense and she sending a letter to the homeowner.

 

 

Bill Warrant:

·         The Board signed the weekly payroll and one bill warrant.

 

 

Other Item:

·         Mr. Lambert informed the Board the BOH office will be moving into the Town Hall conference room C in July.

·         Mrs. Grogan spoke to the Town Administrator and he said she would have to use her personal days by the end of July.

 

 

Other Item:

 

·         Mr. Lambert said the hazardous waste day went well over all. He wanted to thank the Highway and the Fire departments for there help. Letters of thanks will be sent out.

 

·         Mr. Buckley suggested for the next year hazardous waste day the time should be changed to 8:00 to 12:00 pm

 

 

Mr. Buckley made a motion to adjourn the meeting. Mr. Marriner seconded it. A vote was taken. All were in favor.
