February 23, 2010 Meeting Minutes



Call to order:   The Pepperell Board of Health was called to order at 7:00 PM by Mr. Lambert

Minutes to be approved:   Mr. Marriner made a motion to approve the minutes of January 19, 2010                                          Mr. Buckley seconded it. A vote was taken. All were in favor.

Landlords of 38 Mill St.


·          Landlords of 38 Mill St. Apt #3 had an inspection on 12/29/09.

·         A letter was sent to landlords stating there were some flooring issues, water test on 2/1/2010 (lead) determination, smoke detectors needs batteries minor violations.

·         Health Agent Garbarz asked them to come before the Board to explain why these violations had not been corrected within the 30 day time frame given.

·         Mr. Clark stated “he had called a flooring company to replace the floor”.

·         Tenant refused to allow the floor company in his unit to replace floor. A second attempt was made to go into the apartment to rectify the flooring problem. Once again he stated “once he moves out then they can come in and make corrections to the apartment”.

·         The landlord and tenant have a court date to resolve the situation. The landlord will contact the BOH of the courts decision.










Mr. Buckley made a motion to give the Clark’s an extension to correct the minor violations.


Mr. Marriner seconded it.


All were in favor.

·         Health Agent Garbarz had done an inspection and found 3 violations. A letter was sent to the landlord discussing the violations and the 30 day time frame to correct violations. The Health Agent was to do a re-inspection. Landlord did not respond to the BOH in the time allowed. The Health Agent asked landlord to come before Board to explain why it has gone beyond the 30 days.



·         The landlord explained that 2 of the 3 violations have been corrected. She needs to have repairs to the ceiling.

·         The tenant moved out

·         The landlord in working on having someone come in and fix the ceiling.

·         The Health Agent suggested to the Board, she have an extension of time to correct problem then contact the BOH Health Agent to go out for a re-inspection. No one may rent the apartment until the BOH; Health Agent gives approval that all violations have been corrected. 














Mr. Marriner made a motion to give the landlord Christine Giles an extension to correct the violations with the Health Agent going back to re-inspect.


Mr. Buckley seconded it.














A vote was taken.

·         The Health Agent went through the active files and found this folder had little information. There is no Title 5 inspection report; however there was an outdated soil testing application which shows a failed system.

·         A letter was sent out by the Health Agent to the homeowner asking for any information pertaining to his property.

·         The homeowner has no record of a Title 5. He has called the previous homeowner, waiting for a call back. The mortgage company and realtor had no information pertaining to a Title 5.

·         The homeowner said he would like to tie into sewer but he has no access unless he goes through a neighbor’s property.

·         The Health Agent suggested he talk to the sewer department to see if he has options to tie into sewer. If this is not viable then he would have to have a Title 5, put in a new septic system.

·         The Health Agent told Mr. Young to contact her by Friday February 26, 2010, after he has contacted sewer department.

·         The Health Agent did an initial inspection on July 28, 2009. A letter was sent on February 1, 2010 to the Landlords stating the unit needs to be re-inspected and to contact the BOH discuss the violations will be corrected. It has gone beyond the 30 days and they are here to explain why they didn’t correct the violations and call for a re- inspection.

·         Ms. Krista Pepta explained when they the landlords received the letter they said someone was going to come out after the 30 days to do a follow up and no one came out.






·         The Health Agent said there was no critical violation that required a 24 hour correction. The letter spells out the time frame that the landlord has to correct the violations. I have not heard back from the tenant so that is why I sent a letter went out to the landlords. I have to have the tenant’s permission to do the re-inspection but since she has moved out this may explain why I haven’t from her.

·         The second letter went out stating it has gone past the 30 day period and re-inspection time, so that is why the landlords are before the Board tonight..

·         The Health Agent said there has been a lack of communication.

·         The landlords now has someone else living in the apartment.

·         The Health Agent should have been out there to do a re-inspection to make sure all violations have been corrected. I wouldn’t be opposed to doing a follow up to the initial inspection. I would need the new tenant’s permission.

·         The initial letter that went out in July 2009 said you are not allowed to occupy the dwelling units until all the provisions of Chapter 2 of the sanitary codes are met.

·         The Health Agent would ask the Board for a time for going back to do a re-inspection.

































The Board agreed to a fourteen day extension to allow corrections and have the Health Agent do a re-inspection.



·         The Health Agent presented the Board with disposal construction permit, single component - replacement septic for 8 Blue Herons Way.

New Business: A

Rabies Clinic

·         The Health Agent explained to the Board that she has been in contact with Cathy Howard, Assistant to Dr. Smith Veterinarian.

·         The date of Rabies Clinic will be April 3, 2010 at the Jersey St., Fire Station from 9:00 – 12:00. The shots will be $15.00 per animal. The check/money will go directly to the veterinarian.

·         Notification of event will appear on the Town’s web-site and will be in the newspaper.



Other Item:

·         Mr. Lambert explained to the Board the Health Agent and the Secretary have been going over budget.

·         The Board agrees with the calendar dates for March 2nd & 16th 2010.



Mr. Buckley made a motion to adjourn the meeting. Mr. Marriner seconded it. A vote was taken. All were in favor.
